Pregnancy on the Isle of Man vs the UK: What's Different

Maternity pay and allowance

This is the biggest difference. On the Isle of Man, there is no Statutory Maternity Pay (SMP). Employers are not legally required to pay you during maternity leave. Instead, eligible women claim Maternity Allowance directly from the Isle of Man Government.

Shared Parental Leave was introduced to the Isle of Man on 1 November 2025, around 10 years after the UK. It allows parents to share up to 50 weeks of leave in the first year of their child's life. The regulations were unanimously approved by Tynwald.

Legislation and governance

The Isle of Man is a self-governing Crown Dependency with its own parliament, Tynwald. Employment law, social security, and healthcare on the island are governed by Manx legislation, not UK Acts of Parliament.

Key IoM legislation for parents:

  • Employment Act 2006 — establishes maternity leave (26 weeks ordinary + 26 weeks additional) and paternity leave (1–2 weeks)
  • Employment (Amendment) Act 2024 — introduced Shared Parental Leave (up to 50 weeks) and Parental Bereavement Leave, both in force from 1 November 2025
  • Employment (Amendment) Act 2026 — received Royal Assent in July 2026 and creates the framework for Neonatal Care Leave and Carer's Leave. These rights are not yet in force — the detailed regulations are still being developed
  • Social Security legislation — governs Maternity Allowance, Shared Parental Allowance, and Child Benefit
